1. Acceptance of Terms

By accessing or using the Best MCP List website and services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you may not access the Service. We reserve the right to update or change these Terms at any time.

2. Description of Service

Best MCP List provides a community-driven directory of Model Context Protocol (MCP) Clients and Servers, allowing users to discover, submit, and upvote MCP implementations (the "Content").

3. User Conduct

You agree not to use the Service to:

• Submit false, inaccurate, misleading, or unlawful Content.
• Violate any applicable local, state, national, or international law.
• Infringe upon or violate our intellectual property rights or the intellectual property rights of others.
• Engage in any activity that interferes with or disrupts the Service.
• Attempt to gain unauthorized access to the Service or its related systems or networks.

You must be logged in to upvote Content. We reserve the right to remove Content or terminate accounts for conduct that violates these Terms.

4. User Submissions

By submitting Content (such as MCP Client/Server details) to the Service, you grant Best MCP List a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such Content in connection with the Service. You represent and warrant that you have the necessary rights to grant this license for any Content you submit.

We reserve the right, but are not obligated, to review, screen, or monitor user submissions. We may remove or modify any Content at our sole discretion for any reason, including violation of these Terms.

5. Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Best MCP List and its licensors. The Service is protected by copyright, trademark, and other laws of the United States and foreign countries.

6. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Best MCP List makes no warranties, expressed or implied, regarding the operation or availability of the Service, or the information, Content, or materials included therein. You expressly agree that your use of the Service is at your sole risk.

We do not warrant that the information provided on the Service (including details about MCP implementations) is accurate, complete, reliable, current, or error-free.

7. Limitation of Liability

In no event shall Best MCP List, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

8. Indemnification

You agree to defend, indemnify, and hold harmless Best MCP List and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms.

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
